5. COMMENTS AND SUGGESTIONS FROM CITIZENS PRESENT

Gene Halvorson wanted to ask some questions about services with the annexation of Midway
Township. City Councilors answered all of Halvorson’s questions.
6. UNFINISHED BUSINESS
Rohweder said that the budget reflects a deficit of about $45,000 (for a new squad car and money for the Fairgrounds). McGovern said that the one thing that stands out is the omission of an SRO. He would rather put money aside in the event the school looks into that issue again. Rohweder agreed with McGovern. Putting money aside makes sense. Benson said that he is also comfortable with that recommendation. Request for using Mallet Restoration funds to purchase windows for Caboose (Schwarzbauer) Schwarzbauer stated that he received an email from DM Auto Glass with an estimate for the Caboose. Glass and labor to glue it in is $1945; Glass and labor and gasket is $2245. DM Auto Glass dropped the labor cost as is it for a local landmark. Also, he said that Glen Johnson will put in a dead bolt lock with four keys (Fire dept, City, Police, and museum) for approximately $75. Schwarzbauer went on to praise the Proctor Street Department for their help moving the museum out of City Hall. Rohweder stated that the city has the money set aside for this project. Motion by McGovern, seconded by White and carried: To accept DM Auto Glass’ bid for $2245 (glass, labor with gasket) Arrowhead Paint and Lock Services for the repair of the Caboose in which the money used will be taken from the Mallet Restoration fund. Develop Plan for Using 40 acres owned by the City in North Proctor for Recreational Purposes –Referred to Parks & Rec committee (McGovern) Status of annexation of Fair Board property and old dump site (Bray) Extension of Urban Service Boundary by WLSSD –Letter from WLSSD (Rohweder) Rohweder stated that the City added an addendum to the Comprehensive Plan, and submitted another request to WLSSD to extend the urban service boundary. WLSSD sent a letter back stating that they would prefer a complete version of a new Comprehensive Plan. They will not extend urban services until it is complete. Rohweder explained to the councilors that the Comprehensive Plan was scheduled to be updated in 2014. Benson suggested that the City Administrator write a letter to WLSSD and inquire if this is a long standing practice and when did these requirements take effect. Rohweder said that he will discuss with Attorney Bray. Property on corner of Hwy 2 and 1st Street (Bray) Long Range Planning for Fair Grounds – set up committee with members Schwarzbauer indicated that he has not set up a meeting with Frank Siiro yet. PAHA request to use City warming shack at the outdoor rinks at the Fair Grounds Referred to Parks & Recreation committee (McGovern) Stop sign at 5th Street and 3rd Avenue (White) White stated that there wasn’t a quorum at the Public Safety meeting where this item was to be discussed. Unofficially, he would recommend two stop sign with flashing LED lights, and also painting white stripes at the stopping area for motorists. Brenna said that the county is responsible for the painting as it is a county road. The councilors agreed to proceed with LED flashing stop signs on 3rd Avenue. Selection of Public Hearing date for Sales & Use Tax Exemption Peterson indicated that a public hearing date needs to be established for the Truth in Taxation meeting wherein we would discuss the Sales & Use Tax Exemption. Motion by White, seconded by Schwarzbauer and carried: To set a Public Hearing date of December 2, 2013 at 6:00pm for the Truth in Taxation Meeting. Peterson suggested leaving the levy limit the same. Benson asked what the levy amount is; Peterson replied $1,089,762 for general and debt services. Motion by Schwarzbauer, seconded by McGovern (White opposed) and carried (4-1): To accept the proposed City Levy as presented. Second Reading and Adoption – Ordinance banning the sale, possession, transfer, or manufacture of synthetic or alternative drugs Rohweder reported that this has been published, and this will be the second reading tonight. The Ordinance will be effective in 30 days. White declared that he is opposing this ordinance for several reasons. He feels that the best way to combat this is through education. He stated that prohibition never worked. He feels that it is hypocritical for a city that makes a profit off liquor store sales to propose this ordinance. White continued by reading a prepared speech regarding the promotion of individual liberties. McGovern stated that he defends the constitution everyday; he puts his uniform on to protect the city. He stated he will do everything he can to protect the safety White stated that his research indicates that 12 people have passed away due to the synthetic drugs. He believes that some people use these products safely and legally. He also doesn’t believe that this ordinance can stop all drug use – education has been proven to be effective. Brenna stated that he has to do something to protect his family and his city. McGovern stated that there have been well over 12 deaths in the last six months in Duluth alone. This ordinance is for these items used as hallucinogens, and this going to try to control the problem. He agrees with drug education, as he taught DARE in the schools. He also stated that currently the Duluth Police Department is seeing one case each day of excited delirium which is a medical condition Motion by McGovern, seconded by Brenna (White opposed) and carried (4-1): To adopt the Ordinance banning the sale, possession, transfer, or manufacture of Proposed Ordinance banning the sale, possession, transfer, or manufacture of synthetic or
alternative drugs

Council on September 3, 2013.
_________________________ Date: _____________________
James Rohweder, City Administrator
Rohweder said that this ordinance has been updated and some additional fines Motion by McGovern, seconded by Benson and carried: To accept the City Administrator’s recommendation and changes to the Parking Ordinance Approval of Revised List of Administrative Offenses and Penalties Motion by Benson, seconded by McGovern (White opposed) and carried (4-1): To approve the Revised List of Administrative Offenses and Penalties PUC Recommendation of bid for 1st Avenue Water Main Rohweder discussed SEH’s recommendations regarding the bids for the project. Public Utility Commission has approved the low bidder for the project and is making the same recommendation to the Council. Benson asked how many parcels will be affected, and Rohweder stated about 10 to 12. Rohweder said that this water main will complete a loop which is better for our water system. McGovern asked if this was being paid by the PUC fund, Rohweder confirmed. Motion by Brenna, seconded by McGovern (White opposed) and carried (4-1): To accept Ellison Drainage’s bid for the 1st Avenue Water Main project. SEH proposal for sign inventory and updating hydrants and water valves Rohweder stated that the City has to update signs according to a Retro Reflectivity Law. The first step is to have an inventory which the City Engineer would do. He will have GPS coordinates of each sign. The cost will be $5600. PUC also asked for GPS coordinates for the water valves and hydrants. If the two are done together, it will be less expensive. Motion by McGovern, seconded by Brenna and carried: To accept the SEH proposal for sign inventory and updating hydrants and water valves. White stated that this topic was also brought to the Public Safety meeting, however there was not a quorum. Unofficially, they would agree with the Milk House about needing a new curb cut. This would prevent the semi trucks from backing onto the highway. The owner would be paying for the work to be done. Motion by Schwarzbauer, seconded by White, and carried: To agree with the request for a Curb Cutout at the Milk House as presented. Speed Study –Kirkus Street (Eastbound toward Boundary) Rohweder reviewed the additional speed study that Chief Wobig did for the Eastbound traffic on Kirkus Street. The study showed that 30mph is an adequate speed for Kirkus Street. Schwarzbauer appreciates the Street Department moving the heavy items lately. They are very close to having the entire room cleaned out, they should finish tomorrow. 8. LABOR AND NEGOTIATIONS ISSUES

Rohweder stated that the hearings start next Monday, September 9, 2013.
MEMBER CONCERNS

Rohweder said that Carol Lind, Manager of the Utilities department, wanted to notify the council
that they have had meetings with Minnesota Power regarding the frequent outages in the City.
They have agreed on a project with phases to work out the power outages. Minnesota Power will
pay for ½ of the costs, and PUC will pay for the other ½.
Schwarzbauer asked if anyone has heard about the new location of the Whole Foods Co-op.
White said that he knows that Whole Foods is looking for a city that has a local community
garden and also sets up a local food market. Schwarzbauer will talk to a local family to
determine if they would be willing to assist in these requirements.

Thomas berry interview for resurgence 2

Thomas Berry’s book, The Dream of the Earth, has long been an inspiration to me. When I read his new book, The Great Work, which challenges us to search for a mutually enhancing relationship between humans and the planet, I knew I wanted to meet him. I visited him at his home in the Southern Appalachians, where he lives in three rooms above an old stable block surrounded by the memorabilia of a
