TOWN BOARD MINUTES, TOWN OF PROVIDENCE, JUNE 20, 2013 Minutes of the Town Board Meeting held by the Providence Town Board on June 20, 2013 at the Town Hall in Barkersville. The following members were present: Supervisor: Supervisor Collyer called the meeting to order at 7:00 pm with the Pledge of Allegiance.
06202013-91 Councilman Cummings made motion and was seconded by Councilwoman
Vandenburgh to approve the minutes of 5/16/2013. Councilwoman Vandenburgh, Councilwoman
Winney, Councilman Cumming and Supervisor Collyer were in favor, Councilwoman Lee
abstained, motion carried. Supervisor Collyer reviewed his correspondence: 1. Congressman William Owens encouraging the use of natural gas 2. Leadership Saratoga is currently seeking applicants 3. Time Warner Cable: writing to us as part of our ongoing efforts to keep you apprised of developments affecting Time Warner Cable subscribers in the Capital District/Berkshires/Essex County areas (x2) 4. Time Warner Cable: effective 7/23/2013, TWC will take another important step towards adding additional programming and improving internet speeds by reclaiming bandwidth through providing existing programming in digital format only. 5. Time Warner Cable: to let the town know about a new interactive technology we are implementing within the local franchising area known as Switched Digital Video (SDV) 6. Saratoga County Office for the Aging, The Senior Sentinel, June 2013 7. New York State Association of Counties, NYSAC News, Spring/Summer 2013 8. 4-H Highlights, Saratoga County, June 2013 9. National Health Survey: From 5/18/2013 through 7/28/2013 approximately 525 randomly selected area residents will have the opportunity to participate in the National Health and Nutrition Examination Survey. 10. Galway Public Library, Spring and Summer 2013 newsletter Colleen Zabielski, (Northwoods Ginseng, LLC) 231 Southline Road, has submitted a site plan application to sell ginseng from her garage. Any ginseng dealer residing in NY must obtain a license - Colleen is licensed through NYSDEC. Colleen is planning on putting a sign on the property and will see clients by appointment only.
06202013-92 Councilwoman Vandenburgh made motion and was seconded by Councilman
Cummings to exempt Colleen Zabielski (Northwoods Ginseng, LLC) from site plan review since the
business of selling wild ginseng will be home-based. All in favor, motion carried. TOWN BOARD MINUTES, TOWN OF PROVIDENCE, JUNE 20, 2013 WHEREAS, the NYS Office of Real Property Tax Service has notified the Towns with Sole Appointed Assessors that said appointment terms are expiring on September 30, 2013, NOW THEREFORE, BE IT RESOLVED, that Victoria L. Hayner be appointed as Sole Assessor of the Town of Providence for a term that begins on October 1, 2013 and expires on September 30, 2019, and be it further RESOLVED, that a certified copy of this resolution be forwarded to the NYS Office of Real Property Tax Service.
06202013-93 Councilwoman Lee made motion and was seconded by Councilwoman Vandenburgh
to adopt the above resolution re-appointing Victoria L. Hayner sole Assessor of the Town of
Providence for a term that begins on October 1, 2013 and expires on September 30, 2019. The Town Board was polled: Councilman Cummings: yes; Councilwoman Winney: yes; Supervisor Collyer: yes; Councilwoman Lee: yes; Councilwoman Vandenburgh: yes. Motion carried. Sergeant Geoffrey Bullock, from the Village of Galway Police Department, was at tonight’s meeting to answer questions from the town residents in reference to the town board giving consideration to the Village of Galway Police Department to provide law enforcement to the Town of Providence. Supervisor Collyer stated that tonight’s meeting was not a public hearing – but a chance to ask brief questions. Forty-five people were at tonight’s meeting. Mark Genier submitted a petition with 23 signatures in favor of the Village of Galway Police Department patrolling the Town of Providence. Some items of discussion:  Liability: Liability is covered under Village of Galway Police Department’s, If they are
dispatch by the Saratoga County Sheriff’s Department or New York State Police they are covered by their insurance.  Jurisdiction and Certfication: They have jurisdiction in the Town of Providence if
dispatched by the Saratoga County Sheriff’s Department or New York State Police for felonies & misdemeanors. The Town of Providence would have to grant jurisdiction for patrols and traffic infractions.  Cost: budget request of $4,000 for 6 months beginning 7/1/2013 until 12/31/2013.
Sergeant Bullock stated that there would be an increase in the number of tickets in the town that were written and that would more than pay for the cost of the patrols. Effectiveness would be measured by the number of tickets written and the revenue coming in. Money from the fines goes to the town and/or state – no additional money would be given to the Village of Galway Police Department.  Patrols: Random weekly patrol – no schedule, all depends on the availability of the
officers – benefits of the patrols would be crime prevention & vehicle infractions – support other law enforcement agencies, not take over  Vehcile: The car could be labeled Town of Providence or they would use the Village of
Galway Police Department Vehicle and a letter would be given showing proof of jurisdiction, no additional funding would be requested for fuel or maintenance (many times repairs of the vehicles are paid by the officers personally)  No statistical information available showing the need.  There are no lawsuits/investigations against the Village of Galway Police Department  Bullock stated that they were anxious to work with the town residents  Bullock was specifically asked if the Town says no thank you to patrols, and you are dispatched by NYS Police or Saratoga County Sheriff, would you still respond: I don’t know, would depend on the severity of the call TOWN BOARD MINUTES, TOWN OF PROVIDENCE, JUNE 20, 2013  Contract can be stopped with two week notice from either side Sergeant Bullock submitted a proposed municipal agreement for the town to consider.  Councilwoman Lee: Would like to table discussion, no money in this year’s budget, would  Councilwoman Vandenburgh – Does not want to entertain any decision until after an advertised public hearing is held and feels that the decision should be made by public  Councilman Cummings: would like to digest what was said at the meetings, read the petition submitted and then make a ration decision, possible put on the ballet  Supervisor Collyer: After listening to the people at the meetings, and talking to the town’s people, it is in the best interest to do nothing at this time. The attorney has told the board that a public hearing and/or referendum is not legally required, but could be held  Councilwoman Winney: table this until the town’s people decide this is what they want and
06202013-94 Councilwoman Winney made motion and was seconded by Councilwoman Lee to
table any talk about giving consideration to the Village of Galway Police Department to provide law enforcement to the Town of Providence for a period of 6 months. Councilwoman Lee, Councilwoman Vandenburgh, Councilwoman Winney and Supervisor Collyer were in favor, Councilman Cummings voted no (wants put on the ballot for residents to decide). Motion carried.
Dog Control Officer Schwab was asked if he was issuing tickets for unlicensed dogs from the list of
delinquent dog licenses. (39 from August 2012 – April 2013). Schwab stated that he had just
received the necessary accusatory form from the Town Attorney and was going to get the form
copied in triplicate. Councilwoman Vandenburgh stated that she was surprised that we were just finding out that the accusatory form was needed. Councilwoman Winney expressed her frustration that excuses were being made for not issuing the tickets for the unlicensed dogs and she also stated that she did not like Schwab’s response to Supervisor Collyer’s email (about the need to issue tickets for unlicensed dogs) and added that the Supervisor should be treated with respect. Schwab stated that he never received a job description. Supervisor Collyer stated that everyone has to do their jobs. Old Business:  Survey town hall – Charles Ackenbauer has completed the survey but pins have not been  hemlock tree was planted behind the town hall, Tim Vandenburgh repainting saw and  Planning Board will hold workshop meeting on June 27th to review subdivision regulations  Town Beach – lifeguard needed for certain days  Salt shed – no money yet – state contacted last week, Senate hasn’t signed of  Time Warner contract – Town Attorney to update Town Supervisor  Town Pictures – new contractor is needed Highway Superintendent Whitney reviewed his monthly report. TOWN BOARD MINUTES, TOWN OF PROVIDENCE, JUNE 20, 2013 Councilwoman Lee stated that more mulch might be needed for the landscaping around town hall and she will be in contact with the building & grounds committee. Councilwoman Vandenburgh expressed concerns about the meeting that was held last week with the Providence Volunteer Ambulance Corp. She has concerns about the unwillingness of PVAC to provide a copy of its complete financial disclosure documentation within one hundred twenty (120) days after the end of the Company’s fiscal year to the town and also that three family members were on the Board of Directors. Vandenburgh is asking permission to obtain confirmation as to whether or not the Town of Providence Volunteer Ambulance Corporation (PVAC) is subject to the oversight/audit authority of the Office of the State Comptroller. At the June 13, 2013, Tom Matney stated that the PVAC has the operating certificate to operate in the town and they must give it up in order for someone else to respond. Councilman Cummings stated that he has talked to Lee Burns, BS EMTP, who is the Director of Medical Services for the New York State Dept. of Health, and she stated that the comment was untrue and that there were three ways in which to transfer the operative certificate to another entity: 2. Town of Galway petitions the state 3. The Town of Providence Town Board files a certificate of need
06202013-95 Councilwoman Lee made motion and was seconded by Councilman Cummings to
accept the following reports, as submitted: Town Clerk Wemple May 2013, Justice Cummings May 2013, Justice Lahoff May 2013, Code Enforcement Kenyon and Talmadge May 2013, Highway Superintendent Whitney 5/13/2013 – 6/16/2013, Assessor Hayner June 2013, Supervisor Collyer May 2013 and Dog Control Schwab 5/16/2013 – 6/20/2013. All in favor, motion carried.
06202013-96 Councilwoman Vandenburgh made motion and was seconded by Councilwoman Lee
to pay the highway bills: warrant #6, claim nos. 112-128, in the amount of $35,128.86. All in favor,
motion passed.

06202013-97 Councilman Cummings made motion and was seconded by Councilwoman Winney
to pay the general bills: warrant #6, claim nos. 141 - 171, in the amount of $9,475.78. All in favor,
motion passed.

06202013-98 Councilwoman Vandenburgh made motion and was seconded by Councilwoman Lee
to accept the May 2013 highway payroll, n the amount of $23,532.36, as paid. All in favor, motion
carried.

06202013-99 Councilwoman Lee made motion and was seconded by Councilman Cummings to
accept the May 2013 general payroll, in the amount of $20,843.75, as paid. All in favor, motion
carried.

06202013-100 Councilman Cummings made motion and was seconded by Councilwoman Winney
to adjourn the meeting. All in favor, motion carried.
